Proposal Terms
Quote Terms and Conditions.
These terms apply to Diamond Polish & Coatings proposals unless the proposal itself states otherwise.
Proposal Commitments
- Diamond Polish & Coatings will hold its proposal open for 30 days from the proposal date.
- Diamond will provide complete turn-key work for the scope specifically included in the proposal, including required labor, materials and equipment.
General Clarifications & Exclusions
- Unless different terms are specifically stated in the proposal, 50% of the proposal amount is due before the project starts and the remaining balance is due upon completion. Checks should be made payable to Diamond Polish & Coatings and mailed to 31902 Industrial Park Dr, Pinehurst, TX 77362.
- Performance of the quoted scope is contingent upon a mutually acceptable contract between the client and Diamond Polish & Coatings. Diamond is not obligated to provide products or services until an agreement has been accepted by both parties. Acceptance of an unaltered Diamond proposal is sufficient unless otherwise required by the proposal or project contract.
- The proposal does not assume that prevailing-wage requirements or an existing collective-bargaining agreement apply to Diamond's work unless specifically stated.
Concrete Polishing Clarifications & Exclusions
- Diamond installers must be provided uninterrupted access to the work area during installation.
- Areas to be processed must be cleared of furniture, fixtures and movable equipment by the client before the installation crew arrives.
- Other construction activity must stop in the areas being processed, and other trades must remain out of those areas during Diamond's installation work.
- The client must provide reasonable slab access for loading and unloading. Forklifts or other material-handling equipment required because of rough terrain, muddy conditions or upper-floor material movement are excluded unless specifically included and must be provided by the client or handled by change order.
- The final appearance of polished concrete depends heavily on the existing concrete substrate. Diamond is not responsible for unforeseen defects in the slab. The client is responsible for providing a clean, sound, flat and properly troweled concrete surface. Variations in texture, aggregate exposure, staining or defects caused by prior conditions or other trades are outside Diamond's control.
- When an area is covered by existing flooring, Diamond cannot guarantee the condition or appearance of the concrete substrate until the existing flooring has been removed.
- Polished concrete cannot be guaranteed to remain permanently sealed against oil, fuel, solvents or other staining materials. Certain chemicals may stain or damage concrete even when a guard product has been applied.
- Unless specifically included in the proposal, the following are excluded: moderate or heavy aggregate exposure; risers and stairs; added color; concrete patching or crack repair; decorative scoring; floor protection before or after installation; control-joint cleaning or filling; and removal of paint, drywall mud or other materials left by other trades.
- Pricing is based on one mobilization unless otherwise stated. Additional mobilizations may result in additional charges.
- Construction water, restroom facilities and general 110/220-volt power are to be provided to Diamond at no charge.
- Color, texture and pattern samples are representative. Reasonable variations within industry standards may occur.
- Changes to approved colors or patterns require at least 48 hours' notice before the affected work begins.
- Moisture vapor emission / moisture vapor transmission mitigation is excluded unless specifically included in the proposal.
- Diamond requires a preconstruction meeting to review applicable means, methods and products before work begins.
- Pricing is based on regular-time work unless otherwise stated. Overtime, weekend and night work are excluded unless specifically included.
Proposal controls. When a Diamond proposal contains project-specific terms that differ from this page, the written proposal or mutually executed contract controls for that project.
Diamond Polish & Coatings reserves the right to update these website terms from time to time. Terms applicable to an accepted proposal remain subject to that proposal and any mutually executed contract.
